Lyne, Woodworth attorneys were retained to represent one of Massachusetts’ largest employers in a case of alleged wrongful termination based on age discrimination, which is prohibited under the Massachusetts anti-discrimination statute. However, the plaintiff chose not to pursue administrative relief available through the Massachusetts Commission Against Discrimination (MCAD), but instead to go directly to a court of law for his remedy. We were successful in blocking this approach as an appropriate attempt to circumvent the administrative remedies provided by the statute. The plaintiff’s case was dismissed and this dismissal was affirmed by the Supreme Judicial Court.
